O Estudo Técnico Preliminar como ferramenta de gestão no planejamento das contratações de materiais operacionais do CBMDF

Abstract

Tendo em vista o Decreto Federal nº 10.024/2019 de 20 de setembro de 2019 que deu nova regulamentação a Lei Federal10.520/2020 – Lei do Pregão Eletrônico, apresentou um novo documento para a fase de planejamento, o Estudo Técnico Preliminar (ETP). A pesquisa realizada debruçou-se sobre a apresentação deste documento nas aquisições de materiais operacionais no âmbito do Comando Especializado do Comando Operacional (COMOP) do Corpo de Bombeiros Militar do Distrito Federal (CBMDF). Assim, a pesquisa teve como objetivo entender como o ETP pode ser um instrumento de gestão no planejamento das contratações de materiais operacionais. Para tanto, foi necessário verificar como ocorre a gestão do planejamento das aquisições de materiais operacionais no âmbito do COMOP/CBMDF; verificar os aspectos de rotina de planejamento da elaboração dos ETP´s para as aquisições de materiais operacionais no âmbito do COMOP/CBMDF; analisar os ETP´s apresentados nos processos de contratações de materiais operacionais no âmbito do COMOP para o ano de 2020; apresentar o sistema ETP digital e identificar pontos de mudança no Projeto de Lei nº 4.253/2020 em relação a Instrução Normativa nº 40/2020 – ME sobre os ETP´s. A pesquisa foi classificada como aplicada com método dedutivo. O nível de pesquisa foi a exploratóriadescritiva. Neste sentido, a classificação da pesquisa foi bibliográfica, documental e de levantamento de campo utilizando como técnica as entrevistas aos setores demandantes das unidades operacionais especializadas e gestores dos setores do planejamento das aquisições. Diante disso, verifica-se que o planejamento das aquisições se inicia com a aprovação do orçamento do CBMDF junto a Lei Orçamentária Anual (LOA) para posteriormente, elencar as prioridades nas aquisições do CBMDF. Identificou-se que o ETP é o segundo documento a ser produzido na fase de planejamento e, consequentemente, por força dos normativos internos não é o documento que subsidia a confecção do Termo de Referência (TR); analisou-se os ETP´s produzidos no ano de 2020 pautando-se sobre o roteiro da IN nº 40/2020- SEGES/ME e do Manual on-line RCA/TCU, cujos os resultados foram demonstrados utilizando-se gráficos em barra; apresentou-se o sistema ETP digital que consiste em uma ferramenta digital da plataforma governamental do Comprasnet. Deste modo, obteve-se ainda como resultado que o CBMDF está apto a utilizar o sistema; identificou-se que não haverá pontos de mudanças com a sanção do Projeto de Lei nº 4.253/2020 para a confecção e apresentação do documento objeto de estudo. Por fim, conclui-se com a pesquisa que o documento ETP possui a finalidade de ferramenta na gestão do planejamento das aquisições de materiais operacionais no âmbito do COMOP/CBMDF.

In view of Federal Decree No. 10,024 / 2019 of September 20, 2019 that gave new regulation to Law 10,520 / 2020 - Electronic Auction Law, presented a new document for the planning phase, the Preliminary Technical Study. The research carried out focused on the presentation of this document in the acquisition of operational materials within the scope of the Specialized Command in the CBMDF Operational Command. Thus, the research aimed to examine how ETP can be understood as a management tool in the planning of contracting operational materials. Therefore, it was necessary to verify how the management of the planning of the acquisition of operational materials takes place under the scope of COMOP / CBMDF; identify how the ETP´s are elaborated for the acquisition of operational materials within the scope of COMOP / CBMDF; analyze the ETP´s presented in the contracting of operational materials under the COMOP for the year 2020; introduce the digital ETP system; identify points of change in PL 4.253 / 2020 in relation to IN 40/2020 - ME on ETP´s; understand how the Preliminary Technical Study can be a management tool in the planning of the acquisition of operational materials under the scope of COMOP / CBMDF. The research was classified as applied with a deductive method. The research level was exploratory-descriptive. In this sense, the classification of the research was bibliographic, documentary and field survey, using as a technique the interviews with the demanding sectors of the specialized operational units and managers of the sectors of the acquisition planning. Therefore, it appears that the planning of acquisitions begins with the approval of the CBMDF budget with the LOA to later list the priorities for CBMDF acquisitions. It was identified that the ETP is the second document to be produced in the planning phase and, consequently, by virtue of internal regulations, it is not the document that supports the making of the Term of Reference; The ETP´s produced in the year 2020 were analyzed based on the script of IN nº 40/2020-SEGES / ME and the online Manual RCA / TCU, whose results were demonstrated using bar graphs; The digital ETP system was presented, which consists of a digital tool from the governmental platform of Comprasnet. In this way, it was also obtained as a result that CBMDF is able to use the system; It was identified that there will be no points of change with the sanction of Bill No. 4,253 / 2020 for the preparation and presentation of the document under study. It was understood that ETP can be a management tool in the planning of the acquisition of operational materials within the scope of COMOP / CBMDF. Finally, it is concluded with the research that the ETP document has the purpose of being a tool in the management of the planning of the acquisition of operational materials within the scope of COMOP / CBMDF.
